Apex Hosting considers user privacy paramount, and Apex Hosting utilizes great care in keeping the information of the customer and/or user (“Customer”) private and secure. To demonstrate our firm commitment to privacy, the following agreement has been created to explain our policies and procedures in relation to all data collected.

Types of Data Collected

Apex Hosting collects data related to our users through the following methods:

  • Automated means such as communication protocols and cookies
  • Online registration and online signup forms
  • Sales inquiries and transactions
  • Online Customer communications

Depending upon the method of collection and use, the data collected may include information about the user from forms, registrations and transactions (such as name, address, company and e-mail address), information about use of Apex Hosting web sites (such as electronic communications protocols, web pages visited, and cookies) and user preferences and privileges.

We store the data on our billing server, control panel server and game servers.

Electronic Communications Protocols and Cookies

Apex Hosting may receive data from you as part of the communication connection itself through the standard electronic greeting between your computer and our servers. This information often consists of network routing (where you came from), equipment information (browser type), internet protocol address, date and time. At this time our server will also query your computer to see if there are “cookies” previously set by apexminecrafthosting.com to facilitate log in or other site navigation procedures. We store logs of all communications and administration actions for your account management and security.

The Data We Collect and How We Use It

Apex Hosting collects data from users for the following purposes:

  • To engage in transactions for service. We collect your name, address, phone number, username, company name, email, and purchase details. We do not store credit card/payment information which are part of the transaction history. The majority of the data collected under this category is contact information. Apex Hosting may need to share some of this data (address, name, payment) with credit card clearing houses, banking institutions, and other similarly situated Agents, who may require the information in order to complete the transaction (as used here, “Agents” are persons or companies who act on behalf of or under the direction of Apex Hosting).
  • To contact you with news, updates and special offers if you choose to opt-in to our marketing newsletter.
  • To provide appropriate permissions for control panel account and game server daemons.
  • As you browse apexminecrafthosting.com and other websites, online ad networks we work with may place anonymous cookies on your computer, and use similar technologies, in order to understand your interests based on your (anonymous) online activities, and thus to tailor more relevant ads to you. If you do not wish to receive such tailored advertising, you can visit this page to opt out of most companies that engage in such advertising. (This will not prevent you from seeing ads; the ads simply will not be delivered through these targeting methods.)
  •  To provide future service and support. Information collected for this purpose is both contact data and information related to products and service/support requested. This information is also used to provide service, product update, and similar notices.
  • To select content. Data may be collected to help create web site content and navigation that is most relevant and user friendly. This includes data collected as a result of site navigation, as well as data provided in forms.
  • To respond to user inquiries and requests for information. This data includes registrations for online newsletters, opt-in mailing lists and specific requests for further information.
  • To respond to law enforcement organizations, government officials, or third parties when compelled by subpoena, court order, or applicable law, or to report or prevent suspected fraudulent or illegal activity in the use of Apex Hosting’s services. Apex Hosting will notify Customer of the information request or submission as, and if, allowed.
  • To better tailor marketing to user needs. We may use information from user purchases and user-specified requirements to provide you with timely and pertinent notices of product releases and service developments that address your needs and specified requirements.
  • To better respond to requests for service or quotes for product and equipment purchase. Apex Hosting will pass contact information to the appropriate Apex Hosting sales person, or reseller for follow-up related to Apex Hosting products or services.
  • From referral “tell a friend” function. If a user elects to use our referral service for informing a friend about our site, we ask them for the friend’s name and email address. Apex Hosting will automatically send the friend a one-time email inviting them to visit the site. Apex Hosting uses this data for the sole purpose of sending this one-time email and tracking the success of our referral program.
  • To comply with legal requirements, including cooperating with law enforcement, government authorities, or governmental mandate (but when we do, we will disclose only the minimum amount of information required by law).

Additional Information Collection and Processing

Apex uses Google Analytics and Cookies in order to improve our service and user experience and to analyze how our website is used. Aside from the approximate location (IP address), the information collected by Google Analytics is mostly anonymous traffic data including browser information, device information, and language. We do not collect additional information, such as your age, gender, interests, bank details or clickstream. The collected information is used to provide an overview of how people are accessing and using the Apex website. It is not used for any additional purpose, such as to profile those who access our website.

In addition to the foregoing, Apex may collect your information:

  • When You Contact Us

While you can use our website without giving out your personal information, once you contact us via the Apex website, Apex collects information about you. The information you fill in (personal information such as your name, email address, organization) will be processed and stored so that it is possible for us to contact and respond to your request, and/or allow you access to our services.

  • Recruitment

If you apply for a job with Apex, we will collect, process and store the information you have sent us for recruitment-related purposes, such as contacting you. Additionally, MCProHosting may keep your data for a period of time for the purpose of considering you for a different opportunity.

  • Social Media Plugins

Our website features two plug-ins for easy sharing and following our social media pages: Facebook, operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (or any successor address); and LinkedIn, operated by LinkedIn, 2029 Sterling Court Mountain View, CA 94043 United States (or any successor address). Being on our website does not automatically result in sharing data on these social media networks. These plugins remain inactive (idle) until clicked upon. Once clicked upon, you will be taken to the said social media networks with their own specific privacy policies you are recommended to consult.

Legal Bases for Processing

Additionally, certain data protection laws require us to have a “legal basis” and defined purpose before processing any personal information about you. Our legal bases for which we may process your personal information may include:

  • to establish or perform the contract we are about to enter (or have entered) into with you;
  • for our legitimate interests (or those of a third party) which will not override your interests and fundamental rights; this includes many of purposes of processing listed above;

Transfer of EU Data Overseas
With respect to data collected from EU/EEA residents, we process data within the European Economic Area and countries deemed by the European Union as having adequate safeguards for protecting personal data. These countries are recognized by the EU as having suitable safeguards for the rights and freedoms of individuals and recourse processes by which data subjects can exercise their rights.

Customer Portal, Customer Customization, Preferences and Opt-Out

New Customers are automatically registered for access at to https://billing.apexminecrafthosting.com.

The Customer portal allows Customers the ability to create users, add/delete users, add/delete user privileges and opt in (or out) of services and mailing lists. The Customer portal provides the Customers with control over their preferences for electronic information delivery.

Apex Hosting has also provided the Customer’s master user the ability to manage the Customer’s account or profile information. We maintain the data and allow the Customer’s master user to update it at any time. To change this information, you must be a current Customer and login with a user ID and password and follow the prompts to “update my profile.” We continue to expand the profile of services and information that you may access and update.

Please note that some email communications that are transactional in nature are not subject to general opt-out. These include, for example, communications related to downloads; communications about sales transactions; information about software updates, patches and fixes; disclosures to comply with legal requirements; and network upgrades or other related service maintenance.

If an individual’s personal information is to be (a) disclosed to a third party who is not an Agent; or (b) used for a purpose that is incompatible with the purpose(s) for which it was originally collected or subsequently authorized by the individual, then the individual will be notified prior to such disclosure and may opt out of having the information disclosed by responding to the email and/or author of the notification, where such information shall be clearly set forth.

Security

Apex Hosting recognizes the importance of security of the data we have collected and utilizes commercially reasonable measures to prevent unauthorized access to that information. These measures include policies, procedures, employee training, physical access and technical elements relating to data access controls. In addition, Apex Hosting uses standard security protocols and mechanisms to facilitate the exchange and the transmission of sensitive data, such as credit card details. Apex Hosting does not process personal information in a way that is incompatible with the purposes for which it has been collected or subsequently authorized by the individual.

Policy Updates

If we are going to use your data in a manner incompatible with that stated at the time of collection, we will notify you via email. In addition, if we make any material changes in our privacy practices that do not affect user data already stored in our database, we will notify you by email or post a prominent notice on the customer portal notifying users of the change. In some cases, when we post the notice, we will also email users who have opted to receive communications from us, notifying them of the changes in our privacy practices.

We may update this policy from time to time to describe how new site features affect our use of your data and to let you know of new control and preference features that we provide.

US State Law Privacy Rights Statement

This US State Law Consumer Privacy Statement (“Statement”) supplements the remainder of this privacy policy. We do not knowingly sell or share the personal information of minors under 16 years of age without affirmative authorization if we have actual knowledge of the individual’s age. Verifying Requests.
